History

The California Air Resources Board (CARB) of the Cal-EPA and the Scientific Review Panel of special interest activist scientists held a kangaroo court
From the onset they had no intention of "finding" anything other than their preconceived conclusion -- that "cigarette smoke outdoors posed a hazard." 
Official objections by experts were submitted as requested and CARB's answers were essentially "we don't care."
 

Prominent tobacco control scientist Dr. Michael Siegel had already criticized his colleagues for promoting baseless outdoor smoking bans for the damage it causes to the tobacco control movement's credibility: 

"...when the hazard is neither serious nor unavoidable (such as it is with smoking on most streets and sidewalks), we should not have any part in promoting smoking bans, and in fact, should be speaking out against the idea.
It is going to be increasingly difficult to convince policy makers that we are anything other than fanatics if these kind of policies start to go through."
